    Terms of Service

for the Shear Power website, bookings, directory and licences

    Who These Terms Cover:

These terms cover the Shear Power website at shearpower.xyz and what you can do through it: book garden visits, list a business in the gardener directory, buy a Featured listing, and apply for a Shear Power area licence. Shear Power is a trading name of MCN Creative Ltd.

The sections on garden visits apply to customers. The sections on the directory, Featured listings and area licences apply to businesses. The sections on the website, accounts, privacy and the law apply to everyone.

    Scope of Services:

Shear Power Gardening Service provides professional gardening and lawn care services for residential and commercial properties. Services may include grass cutting, hedge trimming, weeding, garden clearing, fence painting, and other gardening tasks as per the customer's request.

In each area the work is carried out by the licensed Shear Power business for that area, and card payments for visits are taken through that business’s own Stripe account.

    Booking and Scheduling:

Customers can book services through the Shear Power website or by contacting our customer service team. Appointments are subject to availability, and customers are encouraged to schedule in advance to secure their preferred time slots.

    Cancellation and Rescheduling:

Customers can cancel or reschedule appointments with advance notice. A cancellation fee of £25 may apply for cancellations made within 48 hours of the planned start time.

    Pricing and Payment:

Prices are based on the type and size of the garden and the selected services. An initial quote will be provided, and final pricing will be confirmed upon assessment of the property. Payment is due upon completion of the service unless otherwise agreed upon in writing.

    Access to Property:

Customers are responsible for providing access to the property at the scheduled time. Shear Power is not liable for any delays or issues related to property access. If access is not provided, a call-out fee may be charged.

    Customer Responsibilities:

Customers should remove any items that could obstruct the work or pose a risk. Specific gardening preferences and concerns should be communicated in advance.

    Quality Guarantee:

Shear Power strives for customer satisfaction and quality service. Customers should report any issues within 48 hours of service completion for resolution.

    Liability:

Shear Power is insured and takes reasonable precautions to prevent damage. However, customers are advised to secure valuable or fragile items. Shear Power is not liable for damage resulting from pre-existing conditions, improper maintenance, or incidents outside our control.

    Privacy and Confidentiality:

Shear Power respects customer privacy and maintains the confidentiality of personal information. Customer information is used solely for service-related purposes and will not be shared with third parties without consent.

    Termination of Service:

Shear Power reserves the right to terminate services for reasons including but not limited to non-payment, unsafe working conditions, or inappropriate behavior by the customer or anyone on the property.

    The Gardener Directory:

Any genuine gardening or lawn care business can ask to be listed free on the page for the area it works in. A free listing shows the business name, phone number and a link to its website. Every listing is checked before it appears, and we may decline or remove one that is inaccurate, duplicated, misleading or not a real gardening business.

Some listings are businesses we found working in an area that have not yet claimed their entry. The owner can claim it, correct it or ask for it to be removed at any time.

If you list a business, you confirm you are entitled to, and you agree to keep its details accurate. You can ask us to remove your listing whenever you like.

Listed businesses are independent of Shear Power unless they are shown as the area’s Shear Power team. Customers deal with them directly, and we do not guarantee their work, prices or availability. Links to their websites are provided for convenience and do not pass search-engine ranking credit.

    Featured Listings:

A Featured listing costs £25 for 365 days, paid once by card through Stripe. It places your listing at the top of your area page, above every free listing, with a Featured badge. There are no more than 3 Featured places in each area. Where the area has a Shear Power team, its panel stays at the top and Featured listings sit directly beneath it.

Featured listings do not renew automatically and no card is kept on file. We email you before it ends; when it does, your listing returns to a free listing with its number and website. We will not remove a paid listing during its 365 days to make room for anyone else.

Every tap on your phone number and click through to your website is counted for you. If that count is still zero after 365 days, email us and we will refund the £25 in full.

A Featured place buys position on the page. It does not guarantee enquiries, work or search rankings.

    Area Licences:

A Shear Power area licence gives one operator the right to run Shear Power in one area, using the Shear Power brand, area page, booking and payment system and the Office. Each licence is granted under a separate written licence agreement, which sets out the fees, the area, notice, selling or handing on the area, and how a licence can end. Where that agreement and these terms differ, the licence agreement applies.

Prices shown on this website are a summary. The fee that applies to you is the one confirmed when you apply, and it is set out in your licence agreement. In addition, a flat £1 is taken from each customer card payment made through the platform; no percentage of your turnover is taken.

If you pay to hold an area while your application is considered, that payment is refunded in full if the licence does not go ahead.

A licence provides the local Shear Power position and the system. Commercial results still depend on the operator, the area and the market, and any future sale of a licensed business is subject to the licence agreement; no resale value is guaranteed.

Accounts and Use of the Website:

Customer accounts, the Office and directory-listing sign-ins are personal to the people they are issued to. Keep your sign-in details to yourself and tell us straight away if you think someone else has used them.

Do not misuse the website: no false listings, no scraping or copying the directory, no attempts to get into accounts or areas of the site that are not yours, and nothing unlawful. We may suspend access where we see misuse.

    Changes to Terms and Conditions:

Shear Power may update these terms and conditions as needed. Customers will be notified of any significant changes.

    Governing Law:

These terms and conditions are governed by the laws of the United Kingdom, and any disputes will be resolved in accordance with these laws.

By using the Shear Power website and services, you agree to these terms. For any questions or further information, please contact us.
